Overview
These Terms of Service ("Terms") govern your use of the Nizami Farms website at nizamifarms.com, our mobile applications, our WhatsApp business service, and any other services we offer (collectively, the "Services"). Throughout these Terms, "we", "us", and "our" refer to Nizami Farms.
By accessing or using our Services, including by placing an order, creating an account, or messaging us on WhatsApp, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you. Our mobile applications are distributed through the Apple App Store.
Please also read our Privacy Policy and Return Policy, which are incorporated into these Terms by reference.

Section 1: Eligibility and account terms
By using our Services, you confirm that:
- You are at least 18 years old, or have the consent of a parent or guardian
- The information you provide is accurate and current
- You are using our Services for lawful purposes only
- You will not use our Services in any way that could damage, disable, or impair them
You may not transmit viruses, worms, or any malicious code through our Services. Any violation of these Terms may result in immediate termination of your access without notice.
Section 2: Account registration
You may use our website as a guest, but to use our mobile app or save delivery preferences for repeat orders, you need to create an account. You can create an account using:
- Sign in with Apple
- Sign in with Google
- Email address with a one-time verification code
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you suspect unauthorized access to your account, contact us immediately at support@nizamifarms.com.
You can delete your account at any time from the mobile app under Account β Delete Account, or by emailing support@nizamifarms.com. Account deletion removes your active account data; certain information may be retained for legal, tax, or fraud prevention purposes as described in our Privacy Policy.
Section 3: Products and pricing
Fresh meat is sold by weight
All meat we sell is prepared fresh to order. Because meat is a natural product, the actual weight of each cut varies slightly from the estimated weight shown at checkout. This means:
- The amount shown at checkout is an estimated price based on standard portion weights
- After your meat is cut, weighed, and packed, we calculate a final invoice based on actual weight
- The final invoice typically differs from the estimate by 3-5%
- We send the final invoice to you on WhatsApp before delivery
- Payment is collected based on the final invoice amount, not the estimate
This is standard practice for fresh meat delivery and is communicated on our website, mobile app, cart page, and order confirmation email.
Frozen products
Frozen items, where offered, are sold at fixed prices because they are pre-portioned and pre-weighed before freezing.
Product accuracy
We make every effort to display our products accurately, but we cannot guarantee that your screen will show colors exactly. Photos are representative of typical product quality and presentation. Cuts may vary slightly between orders as each piece of meat is unique.
We reserve the right to:
- Modify or discontinue products at any time
- Limit the quantity of any item per customer or per order
- Refuse orders that appear to be fraudulent, duplicate, or placed in bad faith
- Adjust prices, which take effect for orders placed after the change
We do not warrant that our Services will meet all of your expectations or be uninterrupted, secure, or error-free.
Section 4: Orders and delivery
Service areas
We currently deliver to: - Islamabad - Rawalpindi - DHA (all phases we serve) - Bahria Town (Phases I through VII)
If your address falls outside our service area, your order will not be accepted. We may expand our service areas over time.
Order acceptance
When you place an order, you make an offer to buy. We accept your offer when we send you an order confirmation via WhatsApp, SMS, email, or in-app notification. We may decline or cancel any order at our discretion, including for reasons such as:
- The item is out of stock
- We cannot deliver to your address
- We suspect fraudulent or abusive activity
- An error in pricing or product description
- Operational constraints such as cutting capacity or delivery scheduling
If we cancel an order after you have paid, we will refund you in full.
Delivery scheduling
We deliver on specific days based on the product category:
- Chicken: Wednesday to Monday
- Mutton and Beef: Thursday to Monday
Delivery days and hours may change for holidays, Qurbani (Eid al-Adha) periods, or operational reasons. Updated schedules are communicated through our website, app, and WhatsApp.
We aim to deliver within the time window communicated at the time of order confirmation. Delivery times may vary based on weather, traffic, area conditions, or order volume.
Risk of loss
Risk of loss and title for items passes to you when the order is delivered to the address you provided. If you are not available to receive the order at the delivery address, our rider will attempt to contact you. If we cannot reach you, the order may be returned to our facility and re-delivery may be subject to additional charges or order cancellation.
Section 5: Pricing, billing, and payment
Currency
All prices are listed in Pakistani Rupees (PKR or Rs.).
Payment methods
We accept the following payment methods:
- Cash on Delivery
- Bank transfer (details shared on WhatsApp after order placement)
- Card payment (where available)
Card payments are processed by Shopify and our payment processors. We do not store your full card number or CVV.
Final invoice and payment timing
For fresh meat orders, payment is collected based on the final invoice amount after cutting and weighing, not the estimated amount shown at checkout. We send the final invoice to you on WhatsApp before delivery. By placing an order, you authorize us to charge you the final invoice amount, which may vary from the estimate by approximately 3-5%.
Account information
You agree to provide accurate and current billing and shipping information. You agree to promptly update your account if any of this information changes, so we can complete your orders and contact you when needed.
Order corrections
We reserve the right to correct any pricing errors at any time before or after order placement. If a pricing error is corrected after you have placed an order, we will contact you to confirm or cancel the order. If we cancel for this reason and you have already paid, we will refund you in full.
Section 6: Returns, replacements, and refunds
If you are not satisfied with the quality of any meat we deliver, contact us within 12 hours of delivery and we will replace or refund the affected item. To make this easy:

We may ask for photos or other details to understand the issue and improve. Our Return Policy provides additional detail.
Section 7: Mobile application terms
This section applies specifically to your use of our mobile applications, available through the Apple App Store.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our mobile application on devices you own or control, solely for your personal, non-commercial use. You may not:
- Copy, modify, reverse engineer, or create derivative works of the app
- Rent, lease, sell, sublicense, or distribute the app
- Remove any copyright, trademark, or other proprietary notices
- Use the app to develop competing products
Updates
We may update the app from time to time to add features, fix bugs, or improve performance. Some updates may be required to continue using the app. You agree to receive updates as part of your use of the app.
Apple App Store specific terms
If you downloaded our app from the Apple App Store, you also agree to the following:
- These Terms are between you and Nizami Farms, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide support or maintenance for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) of the app. To the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims relating to the app, including product liability claims, consumer protection claims, or intellectual property claims.
- In the event of a third-party claim that the app infringes intellectual property rights, Nizami Farms (not Apple) is responsible for handling the claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
Permissions
The app may request certain permissions on your device, including notifications, photos, and contacts. You can grant or deny these permissions and change them at any time in your device settings. Some features may not work if you deny certain permissions.
Section 8: WhatsApp communications
We use the WhatsApp Business Cloud API operated by Meta to communicate with customers. By providing your phone number when placing an order or creating an account, you agree to receive:
- Order confirmations and delivery updates
- Final invoices for fresh meat orders
- Customer service responses
- Replacement and refund coordination
You may also opt in to receive marketing messages from us via WhatsApp. You can opt out of marketing WhatsApp messages at any time by replying STOP, by telling our team, or by emailing support@nizamifarms.com. Transactional messages about your orders will continue regardless of marketing preferences.
WhatsApp is operated by Meta. Your use of WhatsApp is also governed by Meta's terms of service and privacy policies.
Section 9: Acceptable use
You agree not to use our Services to:
- Violate any law or regulation
- Infringe on the rights of others, including intellectual property, privacy, or publicity rights
- Submit false, misleading, or fraudulent information
- Place orders without intent to receive or pay for them
- Harass, abuse, or harm our team, riders, or other customers
- Interfere with or disrupt our Services or servers
- Attempt to gain unauthorized access to our systems
- Use automated tools (bots, scrapers, crawlers) to access our Services without permission
- Collect or harvest information about other users
- Send spam or unsolicited communications through our Services
- Reverse engineer, decompile, or attempt to extract the source code of our software
We reserve the right to terminate your access to our Services for any violation of these Terms, with or without notice.
Section 10: Intellectual property
All content on our Services, including the Nizami Farms name, logo, product photos, descriptions, recipes, website design, and mobile app design, is owned by Nizami Farms or our licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works of our content without our prior written permission, except that you may:
- View and use the Services for personal, non-commercial use
- Share our public content on social media with proper attribution
- Print order confirmations and invoices for your records
Section 11: User-submitted content
If you submit content to us, such as product reviews, photos, feedback, or suggestions:
- You retain ownership of your content
- You grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, and display your content in connection with our Services and marketing
- You confirm that your content is original, accurate, and does not infringe the rights of others
- We may, but are not obligated to, monitor, edit, or remove content that we consider inappropriate, offensive, or in violation of these Terms
We are not responsible for any content you submit or for any content submitted by other users.
Section 12: Third-party services
Our Services may link to or integrate with third-party services, including Shopify, Meta (WhatsApp, Facebook, Instagram), Apple, Google, payment processors, and delivery providers. We are not responsible for these third parties or their terms and policies. Your use of any third-party service is at your own risk and subject to that third party's terms.
Section 13: Accuracy of information
We make reasonable efforts to ensure that information on our Services is accurate and current. However, we are not responsible if any information is incomplete, inaccurate, or out of date. Any reliance on information from our Services is at your own risk.
We may modify or update product descriptions, prices, availability, and policies at any time without notice. We have no obligation to update information on our Services unless required by law.
Section 14: Modifications to the Services
We reserve the right to:
- Modify, suspend, or discontinue any part of our Services at any time
- Change the features or functionality of our mobile app or website
- Change our delivery areas, schedules, or capacity
- Change our prices, with effect from the date of the change
We are not liable to you or any third party for any modification, suspension, or discontinuation of our Services.
Section 15: Disclaimer of warranties
Our Services and products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not warrant that:
- Our Services will meet your specific requirements
- Our Services will be uninterrupted, timely, secure, or error-free
- The results obtained from using our Services will be accurate or reliable
- Any errors in the Services will be corrected
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for personal injury, death, or fraud caused by our negligence.
Section 16: Limitation of liability
To the maximum extent permitted by law, Nizami Farms and our directors, officers, employees, agents, suppliers, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, arising out of or in connection with your use of our Services.
Our total liability to you for any claim arising from these Terms or your use of our Services is limited to the amount you paid us for the order giving rise to the claim, or PKR 10,000, whichever is higher.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not fully apply to you.
Section 17: Indemnification
You agree to indemnify, defend, and hold harmless Nizami Farms and our directors, officers, employees, agents, and partners from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your violation of any law or the rights of any third party
- Content you submit to our Services
- Your use of our Services in any way that causes harm
Section 18: Termination
These Terms apply for as long as you use our Services. You may stop using our Services at any time. We may suspend or terminate your access to our Services at any time, with or without notice, for any reason, including:
- Violation of these Terms
- Suspected fraudulent or abusive activity
- Non-payment
- Operational reasons
Termination does not affect your obligations for orders already placed or amounts owed to us.
Section 19: Governing law and dispute resolution
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict of laws principles. Any dispute arising out of these Terms or your use of our Services will be resolved in the courts of Islamabad, Pakistan, unless required otherwise by applicable consumer protection law.
Before filing any formal claim, you agree to first contact us at support@nizamifarms.com to attempt to resolve the dispute informally. We commit to making a good-faith effort to resolve your concern within 30 days.
Section 20: Severability and entire agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the extent necessary to make it enforceable while preserving its intent.
These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Nizami Farms regarding our Services and supersede any prior agreements.
Our failure to enforce any right or provision of these Terms is not a waiver of that right.
Section 21: Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email, in-app notification, or another reasonable method.
Your continued use of our Services after changes take effect means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using our Services.
